Submission Agreement

 You are the original developer (or are submitting for the original developer) of the submitted project, including, but not limited to, the material, text, data, and other works of authorship used in the submitted project.

You will indemnify and hold Macromedia harmless from any claim related to the submitted project, including any claim by a third-party that your project infringes any copyright, patent, trademark, trade-secret, rights of privacy or publicity, or any other intellectual-property right.

The MAX Awards are a complement to the Macromedia Innovation Award Program, a unique awards program which recognizes outstanding innovative projects produced with technology by faculty and staff at higher education and K-12 institutions, and students. Macromedia may use the submission content in other Macromedia Customer Success Program activities, such as Macromedia Site of the Day, marketing collateral (both printed and online), newsletters, seminars, trade shows, and as a customer example on our website.

If the submission is selected as a category winner, the submitter must agree to be included in a Macromedia press release announcing the winners. The winner will be able to review the release prior to issue. Note: Macromedia is not obligated to use any winners in a press release.

If the submission is selected as a category winner, a representative must attend any and all pre-conference meetings (by phone or in person) as well as the MAX 2005 conference.

Macromedia reserves the right, at our company's discretion, to refuse the submitted project.

IF YOU DO NOT AGREE TO THE PRECEDING, OR IF YOU OR THE DEVELOPER IN WHOSE NAME YOU ARE SUBMITTING THE PROJECT DO NOT OWN OR HAVE RIGHTS TO EVERY ELEMENT OF THE SUBMITTED PROJECT, DO NOT SUBMIT THE PROJECT AS A CANDIDATE FOR A 2005 MAX AWARD. YOU WILL BE FINANCIALLY LIABLE TO ANY THIRD-PARTY THAT OWNS ANY ELEMENT OF THE SUBMITTED PROJECT.
