What is the Premier Education Program?

The Premier Education Program (PEP) is a program of discounts for high-volume purchasing of Macromedia software, upgrades, subscriptions, technical support, and training sold to colleges and universities and K–12 Schools in the U.S. Each Macromedia product is given a point value. The total number of points of your initial order determines the discount you receive: the greater the size of the order, the greater the discount level. This program offers the maximum discounts available for Macromedia products. In addition to the initial purchase discount, the same level of discount is available for reorders during a two-year period following the initial order. PEP is one of the three volume-license offerings available to education customers as part of the Macromedia Volume License Program.

What are the benefits of the PEP?

Besides offering the maximum discounts available on Macromedia products, the Premier Education Program includes the following additional benefits:
· Purchase reorders at the same PEP discount rate for two years from the initial order purchase date
· Coterminous Macromedia Subscriptions with semi-annual prorating (Subscriptions come up for renewal all at the same time)
· Simplified license management, with a single serial number per product, per platform

Does PEP participation require a contract?

In most cases, the Premier Education Program does not require a contract. A complete set of terms and conditions is included with the initial purchase. However, any exceptions or modifications to the standard terms and conditions do necessitate a contract.

How can I purchase through the PEP?

The Premier Education Program is sold directly by Macromedia. You can contact a Macromedia sales representative at PEP@macromedia.com.

I have an existing PEP contract, and I notice that the features of the current program are different from those included in my contract. Does this change the terms of my contract?

Your terms will not change; all contracts in force will remain in force. When your contract is up for renewal, you’ll have the option of qualifying for the new program or renewing any Macromedia Subscription you have under another program, such as the ATLO.

Are there any benefits granted to me as an existing PEP contract holder as a result of recent PEP program changes?

Yes. The following table describes how tiers in the original PEP program map to levels in the updated PEP program. These new mappings are solely for reorders under existing PEP contracts and are not meant to offer renewal pricing or terms:

You will continue to obtain quotes for reorders from your Macromedia contact. You’ll see three major changes to these quotes:

· You can now purchase server products, training, support, and subscriptions at special discount levels not available outside of PEP.
· Your reorders can now consist of many more products, making it potentially easier to reach a minimum qualifying reorder (150 points for a reorder).
· Subscription is now prorated according to the number of whole or partial six-month periods remaining in your contract. For example, if you place a reorder while you have 15 months left before the end of your contract, your subscription will then be based on three-fourths of the original subscription amount, plus the license fee for the new licenses being purchased.


* Please note that Level E is not available to new PEP customers. This level is valid only for customers who purchased at Tier 1 under the previous PEP program.

Our school doesn’t currently participate in the PEP, but we’ve looked at it in the past. What new features or benefits have been added?

The new PEP features and benefits include the following:
· The program is now point-based, with initial order discounts determined by total points ordered. The minimum for participating in the PEP is 3,000 points. The minimum for reorders is 150 points.
· In most cases, a contract is no longer required.
· Server products are now available.
· Items that previously did not count toward your initial order (such as technical support and Macromedia Software Subscriptions) now have point values that help you reach discount levels.
· An additional discount level, Level I, is now available for customers who purchase 22,500+ points of Macromedia products.
· Discount level point breaks are now:
Level F: 3,000 to 7,499 points
Level G: 7,500 to 11,999 points
Level H: 12,000 to 22,499 points
Level I: 22,500+ points
· Macromedia online courses accumulate points along with your order for software, upgrades, subscriptions, and technical support.

What products are available through the PEP?

All major software, upgrades, subscriptions, technical support, and training are available through the Premier Education Program.

How is the Premier Education Program the same or different from the Academic Transactional License Option (ATLO)?

Both the Academic Transactional License Option and the Premier Education Program use the same point listings of Macromedia software, upgrades, subscriptions, technical support, and training for placing orders. For both programs, the size of the order determines the discount level. While Macromedia Software Subscriptions are available as an option in ATLO, customers purchasing through the PEP must purchase Subscriptions along with all software products ordered. ATLO requires an initial total order of 10 points, and PEP requires an initial order of at least 3,000 points. Benefits available to customers purchasing through the Premier Education Program include:
· The maximum discounts available for Macromedia products
· Your single largest purchase determines PEP pricing for two years from the purchase date
· Coterminous subscriptions with semi-annual prorating (all Subscriptions come up for renewal at the same time)
· Simplified license management, with a single serial number per product platform

Why does the PEP require Macromedia Software Subscriptions to be purchased along with software products ordered?

Subscription coverage provides assurance that the latest versions of Macromedia software are available for use by the educational institution. This has proven such a beneficial offering that it’s been incorporated into the Premier Education Program.

Are other license options available from Macromedia?

A variety of license options are available to education customers as part of the Macromedia Volume License Program, including PEP (currently available only in the U.S. only), Academic Transactional License Option (ATLO), Studio MX 2004 K-12 Site License Solution, Macromedia K-6 Site License, Contribute K-12 Site License, Contribute Higher Education Site License, Breeze Education Edition, and Breeze K-12 School Edition. The ATLO offers discounts on boxed-product prices at purchase levels as low as 10 points (the equivalent of two to five software licenses based on their individual point values). The level of discount is determined by the size of each individual order, and no contract is required. You may mix and match Macromedia software, upgrades, subscriptions, technical support, and training. K-12 customers seeking school-wide use of Macromedia Studio MX 2004 and Contribute 3 will find that the K-6 Site License and the K-12 Site Licenses meet the needs of both elementary and secondary schools. In addition to PEP and ATLO, Macromedia offers Breeze Education Edition and Contribute Higher Education Site License colleges and universities.

You’ll receive right-to-copy licenses in accordance with your license purchase, one multi-user serial number per product family (also in accordance with your license purchase), the Macromedia End User License Agreement (as applicable) for both software and technical support purchases, as well as one CD which ships per product, per platform with each order.

May I mix and match Macromedia products to reach program levels?

The Premier Education Program allows you to mix and match Macromedia products and services on several platforms to reach various discount levels.

Do customers use the same part numbers for products purchased under the PEP as for regularly purchased products?

No. Unique SKUs (part numbers) exist for each product at each PEP discount level. Each product family purchased by a given customer has a single multi-user serial number. This simplifies the administration and tracking of volume licenses.

Do all products available through the PEP have point values?

The vast majority of offerings available through the Premier Education Program—including full licenses, subscriptions, and technical support—have points assigned. However, media kits, product CDs, and some support offerings do not.

Is concurrent usage permitted for products purchased through PEP?

Concurrent usage is now available upon request and with our approval. Concurrent usage rights allow eligible customers to distribute Macromedia software to end users through a shared file server that employs license-metering software. License-metering software will not allow the number of licenses in use at one time to exceed the authorized usage. Authorized usage is defined as the number of licenses purchased and registered for a software title. Concurrent usage rights are allowed only on Macromedia tools products, and are not applicable to server products.

Which Macromedia products are offered through the PEP?

Is technical support discounted?

Technical support offerings are not discounted, but they are assigned points to help you achieve a higher program leveland therefore a higher discount on your software purchases.

What is a Macromedia Software Subscription?

A Macromedia Software Subscription entitles you to free version upgrades (for example, an upgrade from version 4.0 to 5.0), updates (for example, from 5.1 to 5.3), and bug fixes during the active Subscription period.
· Subscription coverage lasts for two years. The two-year period begins with the initial product-purchase date and expires on the last day of the month after the two-year anniversary of that date.
· You must purchase Macromedia Software Subscriptions along with any software you purchase through the Premier Education Program.
· Renewal Subscriptions can be purchased up to three months prior to the Subscription expiration date. When renewing any subscriptions, you should renew all of the licenses covered under the Subscription at the same time.

If I have a Macromedia Software Subscription and a new version of a product is released, how do I receive my new software?

Once a new version has been released, we’ll ship the appropriate number of media packs directly to the original “Ship To” contact person on the purchase order (unless the customer has notified us that the contact person has changed). You may then install the current release up to the number of licenses with active coverage. Subscription customers receive a Macromedia Volume License Program Certificate that includes:
· The same program membership number as on previous orders
· Right-to-copy licenses in accordance with the license purchase
· One new multi-user serial number per product family
· Macromedia End User License Agreement (as applicable) for both software and technical support purchases
· One CD at no charge

What are the limitations on the use of the Macromedia software products in my school?

Macromedia software sold to education customers is for use in qualifying K–12 educational and higher education institutions. Education Editions of Macromedia products may be used for instructional purposes by students, teachers, and faculty, but may not be used for any commercial or revenue-generating activities. Software may be installed only on school-owned computers.

May we load the software on mobile computers that students use at home?

Yes, as long as the computers are owned by the institution. We also offer aggressive education pricing on Macromedia products for purchase by both students and faculty for use on their personally owned computers. May I purchase training through the PEP?

Online courses are available for purchase from Macromedia University.

Are curriculum materials available from Macromedia?

Macromedia as a wide variety of curriculum materials available for both K-12 and Higher Education. All of these materials may be purchased in North America in the Macromedia Education Online Store. Many of these materials are also available through Macromedia Authorized Academic Resellers or through our curriculum publishing partner, Course Technology, by calling (800) 648-7450 or by ordering online.

How many discount levels are available in the PEP?

The PEP has four point-based discount levels. A point break is the number of points you need to purchase your individual order at a specific discount level. The following point breaks have been established for each discount level:

Does a specific product’s point value increase at the higher program levels?

The point value of each product remains the same at any level.

Does Macromedia charge for CDs and documentation?

We don’t charge for the initial CD which ships per product, per platform with each order. However, if you order additional CDs and documentation, you’ll be charged a nominal fee.

What if I want additional CDs and documentation? Can I order them?

You can order additional CDs and documentation as separate items for a nominal fee.

Can I purchase more CDs and documentation kits than licenses for any given product?

You may purchase only as many CDs and documentation kits as the number of licenses you have purchased per product.

How does Macromedia ensure that educational institutions use only the number of software products that they’ve been licensed to use?

We may audit you and your records relating to your copying and use of the licensed software—no more than once yearly and during ordinary business hours, after giving reasonable advance notice—for the purpose of confirming your compliance with your certificate. Should we choose to conduct an audit, either party may elect that this audit be performed—on the behalf of Macromedia—by an independent party reasonably acceptable to both parties. You will allow auditors onsite within a reasonable period of time, not to exceed 20 calendar days from the date of the audit notification. If this audit reveals a shortfall in payment, you agree to immediately pay Macromedia the then-current suggested retail price for each copy or installation beyond the number of licenses purchased by you. If this audit reveals a shortfall in payment of more than 5%, you will (in addition to paying Macromedia the past-due amounts set forth above) reimburse Macromedia for the direct out-of-pocket expenses incurred in conducting this audit.

What is the Macromedia Volume License Program (MVLP) freight policy?

All MVLP orders are shipped from our warehouses using a two-day service (such as Federal Express second-day service) or an international equivalent. Freight charges will automatically be added to your order.

What is the return policy?

For the purposes of the MVLP, Macromedia will honor the warranty of the End-User License Agreement. Otherwise, Macromedia will not accept returns for MVLP orders. The only exception to this no-return policy will be for product exchanges on order entry errors corrected within 30 days of receipt of incorrect product.
