General Licensing and EULA Questions

What is a license?

A license entitles you to use resources (software, content, and services) based on the terms outlined in the DevNet End User License Agreement (DevNet EULA). When you buy DevNet Subscriptions, you also purchase a license to use the resources. The DevNet EULA explains how you, the user, can use these resources. When you use the software, content, or services, you agree to the terms in the DevNet EULA, which is a legally-binding document. If you break the DevNet EULA terms, you are breaking the law and subject to penalties and prosecution. Please note that this FAQ is only a partial summary of some of the licensing issues under DevNet Subscriptions, and therefore you should read the entire DevNet EULA before using the resources provided under your DevNet Subscription.

Is the DevNet EULA the same as the End User License Agreement for the individual Macromedia Tools and Server software and other resources contained within the subscription?

No. Anyone who purchases through the DevNet Subscriptions service should read the DevNet End User License Agreement (EULA), which supercedes the individual EULAs for other Macromedia Tools and Server software.

What are the general terms of the DevNet Professional license?

The DevNet Professional license separates the software into three broad categories. Each is licensed in a different manner:

1. Tools. The DevNet Tools software is licensed as single-user, single-computer licenses. The Tools software includes the most recent version of the following:

  1. Macromedia Flash
  2. Dreamweaver
  3. Fireworks
  4. FreeHand
  5. Contribute

2. Servers. The DevNet Server software is licensed to subscribers-only for development-only. Developers can use the DevNet Server software to develop, test, and demonstrate their applications only on a development server. Developers cannot use the DevNet Server software in separate QA, load testing, staging or production environments. The server software includes development-only licenses for the following:

  1. ColdFusion
  2. JRun
  3. Macromedia Flash Remoting
  4. Macromedia Flash Communications Server

3. Components and Extensions. The Components and Extensions are licensed as single-user, single-computer licenses. These include the Components and Extensions released as part of DevNet Resource Kits, such as:

  1. Data Grid
  2. Charting Components
  3. SQL Reference Extension

What are the general terms of the DevNet Essentials license?

The software that is provided as a part of the DevNet Essentials subscription are Components and Extensions. The Components and Extensions are licensed as single-user, single-computer licenses. These include the Components and Extensions released as part of DevNet Resource Kits, such as:

  1. Flash Data Grid
  2. Charting Components
  3. SQL Reference Extension

If I do not renew my DevNet Subscription, can I still use the software, content, and services?

After the subscription expires:

  • You can continue to use DevNet Tools software
  • You can continue to use the Components and Extensions
  • You cannot continue to use the DevNet Server software
  • Access to other DevNet services will be terminated when your subscription expires.

Since my subscription contains multiple products, content and services, can I give some of them to another user?

No you cannot. All of the software included in DevNet Subscriptions are for the use of the subscriber only. The one exception to this is that the DevNet Server software can be freely shared, but only among other DevNet Professional subscribers at your organization.

Can I sell any of my software in my DevNet subscription?

The DevNet subscription cannot be sold in part or as a whole.

I upgraded to DevNet Subscription from another Macromedia product, can I sell or give away my old copy?

By purchasing a DevNet Subscriptions at a discounted price based on your prior purchase of a Macromedia product, you are agreeing to a license exchange, meaning that you voluntarily terminate the license to the prior product(s) you upgraded from and you cannot sell or transfer that product(s) to another person or entity.

Some of the software in my subscription includes product activation. What is it?

Product activation is an anonymous, secure, and hassle-free one-time process that authenticates licensed users during the installation process. Activation is not required for products acquired under a volume license agreement. The activation process verifies that the serial number is legitimate and has not been activated on more systems than allowed by the EULA. It does not affect the ability of licensed users to use their software as they always have. Will I still need to go through product activation if I’ve activated my subscription?

Yes. The subscription activation process enables your DevNet subscription and allows you to access your DevNet account and software. The product activation process occurs during the product's first launch and ensures that the product is only used on as many computers as the EULA allows. These two activation processes are not related.

DevNet Server Software License

What can I do with the DevNet development-only Server software licenses?

You may develop, test, demonstrate and debug your applications on a development server only. Once you install the DevNet Server software on a development server, it becomes a “development-only” machine and you may only do development, testing and demonstration of your application on that machine. You may not allow that machine to be used for any other purpose and you may not put that machine to any production or preproduction use.

For how long can I continue to use my DevNet Server software?

Your DevNet Server software licenses are term licenses meaning that you may continue to use them as long as you remain a subscriber. If your subscription lapses you must cease using the DevNet Server software.

Can other developers on my team use the servers I have set up with DevNet Server software licenses?

Any other developer within your organization who writes, modifies, or directly accesses application source code on a DevNet Server software must be a DevNet Professional subscriber and may use such servers.

Do all of the developers on my team need to have DevNet Professional licenses to use my DevNet Server software?

Anyone who writes, modifies, or directly accesses application source code on Server software licensed under DevNet Professional must work within your organization and also be a DevNet Professional subscriber.

I have a QA team in my company that does end-user testing and logs bugs; can they do QA on servers set up with DevNet Server software licenses?

Your QA team can only test against development servers. You cannot install DevNet Server software products on machines just for QA testing. If you want to use separate servers for QA testing, you must purchase commercial Server software licenses.

Can non-subscribers use my DevNet Server software licenses?

Non-subscribers cannot develop with your DevNet Server software license which means they cannot write, modify or directly access source code. However, non-subscribers within your organization may access your application on a development server for the purposes of testing or demonstration.

On how many machines can I install my DevNet Server software?

You may install DevNet Server software on as many machines as you like within your organization, however, any machine that you install the DevNet Server software must be a development server, which can be used only for development and testing; it may not be put to any other use.

Can I use my DevNet Server software for staging?

No you may not, DevNet Server software is for development only. Staging is considered a production usage.

Can I redistribute my DevNet Server software?

No, you may not redistribute DevNet Server software, or any software received under DevNet subscriptions.

What kind of testing can I do with my DevNet Server licenses?

You can test and debug your code. You cannot perform load testing. Load testing is prohibited under the terms of this EULA.

Can I do load testing on servers that contain DevNet Server licenses?

You cannot perform load testing with DevNet. Load testing is prohibited under the terms of this EULA.

How does the ColdFusion development-only Server software license in DevNet Professional compare with the ColdFusion Developer Edition licensed in Studio MX?

The ColdFusion Developer Edition is a single-IP version of ColdFusion. In contrast, the ColdFusion MX Enterprise development-only Server software licenses, which are available as a part of DevNet Professional, are not limited by IP addresses, they can be accessed by n-number of machines.

The development-only Server software license in DevNet Professional allows DevNet Professional subscribers to build and test their applications as a team (all developers accessing the DevNet Server software must be current DevNet Professional subscribers).

DevNet Tools License

Can I install different DevNet Tools software on multiple machines?

No, DevNet Tools software is sold as a group which may be installed on one machine alone.

For how long can I continue to use my DevNet Tools software?

You may continue to use your DevNet Tools software that you receive as a current subscriber for as long as you choose to do so, subject to your compliance with the DevNet EULA. Your license to use the DevNet Tools software does not expire.

Can I share my DevNet Tools with others?

No, you may not share the DevNet Tools with anyone else, they are licensed to you for your use alone.

Can I redistribute or transfer my DevNet Tools software?

No, you may not redistribute or transfer DevNet Tools software.

DevNet Components and Extensions License

Can I install different DevNet Components and Extensions software on multiple machines?

No, DevNet Components and Extensions software is sold as a group which may be installed on one machine alone.

For how long can I continue to use the DevNet Components and Extensions provided to me with a DevNet Subscription?

You may continue to use your DevNet Components and Extensions that you receive as a current subscriber for as long as you choose to do so, subject to your compliance with the DevNet EULA. Your license to use the DevNet Components and Extensions does not expire.

Can I share my DevNet Components and Extensions?

No, you may not share the DevNet Components and Extensions with anyone else; they are licensed to you for your use alone.

Can I redistribute my DevNet Components and Extensions?

You may NOT redistribute the DevNet Extensions. You may redistribute the Components, however there are strict limits and requirements on how you can do this, as follows:

  1. The Components MUST be distributed only in conjunction with and as part of a software application product developed by you in which such Component adds functionality to such application.
  2. You may not distribute the Components on a stand-alone basis.
  3. You may not make modifications to the Componentsand distribute them; in fact, they cannot be distributed as a Component at all.
  4. You must include your own valid copyright notice in your software application product which shall be sufficient to protect Macromedia’s and/or its licensors’ copyright in the Component.
  5. You cannot remove or obscure any copyright, trademark or patent notices that appear in the Component as delivered to you.
  6. You can not use the Macromedia nor its suppliers’ names, logos, or trademarks or the names of contributors to endorse or promote your software application products without specific prior written permission from Macromedia.
  7. You must distribute your software application product containing the Component pursuant to an end user license agreement with terms no less protective than those contained herein.
  8. You can not permit further distribution of the Component by your end users, except you may permit further redistribution of the Component by your distributors to your end-user customers if your distributors only distribute the Component in conjunction with, and as part of, your software application product and you and your distributors comply with all other terms of this DevNet EULA.

Volume Licensing

How does volume-licensing work?

A company can purchase multiple DevNet Subscriptions licenses for its employees through the Macromedia Volume License Program (MVLP). A company can assign as many individual subscribers as subscription licenses purchased. Even though an individual subscriber uses the license, the license remains the company's property. If the subscriber leaves the company, he/she cannot take the subscription.

Is there a difference for licenses purchased through Macromedia Volume Licensing Program (MVLP)

No. The End User License Agreement (EULA) for volume customers is the same for single DevNet Subscriptions purchased individually or through MVLP.

In a volume purchase, how are the licenses managed? Who owns the license? Can the licenses be transferred?

When a company purchases a volume license, they will have access to a customer-facing, web-based interface on macromedia.com where they can manage their licenses. Among other features, they will be able to view all of the subscribers in their company, the products they are entitled to, and their product serial numbers. As employees move throughout their organization, the administrator will be able to swap existing subscribers with replacement subscribers.

Even though the subscriber is using the license, the subscriber's company actually owns the license. If the subscriber leaves the company or moves into another position within the company that does have have a developer subscription, the subscription will not move with them.

Developer subscription licenses cannot be transferred to another company.
